PMX is curtailing the discretionary powers of the Agong by stealth

Amendments to the IHR and the ‘pandemic treaty’ will give authority to the WHO to declare emergencies

The current Madani government is allowing the monarchy to lose some of their discretionary powers.

The Agong is the last line of defence against abuse of power by politicians

Back in October 2020, the then embattled prime minister Muhyiddin Yassin was refused a request to declare a national emergency over the Covid-19 crisis by the Yang Di-Petuan Agong Al-Sultan Abdullah Ri’ayatuddin Al-Mustafa Billah.

Al-Sultan Abdullah had consulted with his fellow Malay rulers, and was hesitant to allow the declaration of the first state of emergency since 1969, as it could lead to the suspension of parliament and increased powers to the executive branch, which could lead to potential abuse of power.

Al-Sultan Abdullah was of the opinion there was no need at the time for His Majesty to declare a state of emergency.

Last year, the MOH recommended the curtailment of Agong’s powers through IHR amendment recommendations.

Former Ministry of Health Director-General, Nor Hisham Abdullah in 2022 oversaw the Ministry of Health International Health Regulations Focal Point Committee. The committee sent a large number of recommendations to the WHO, for International Health Regulations amendments. Some of these recommendations would allow WHO recommendations binding upon the Malaysian government.  

The MOH committee sent a recommendation to the WHO IHR stating that the new regulations, including Article 15 and 16, Shall be initiated and completed, without delay by all state parties. Articles 15 and 16 refer to health measures mapped out by the WHO.

This amendment makes WHO recommendations mandatory upon member states These new regulations take away the latitude of individual countries to make their own decisions about declaring emergencies. This power would be the sole authority of the WHO Director General, under international law.

The WHO Director General will have the sole authority to declare an emergency. Currently in Malaysian, only the Agong has this power.

This in effect would take control away from the Yang Di-Petuan Agong, and is thus a loss of sovereignty and discretionary powers of Malaysia’s monarchy – a form of neo-colonialism.

Thus, come the last week of May 2024, the Yang Di-Petuan Agong will have lost discretionary power to call an emergency related to Malaysia. Under the new WHO regulations, this is not restricted only to health issues.

The Anwar administration is allowing the Agong to lose some of his discretionary powers

The Anwar administration has done nothing to prevent this loss of power by the Agong.

Dr Zaliha Mustafa will go down in Malaysian history as the minister who oversaw a power-grab from the Agong.

Anwar and his minister for health Dr Zaliha Mustafa are either unaware of this move by the former government or in collusion to erode the powers of the Agong.

The new director general of health Dr Muhammad Radzi, who was deputy director general under Nor Hisham at the time has NOT informed the Madani administration of this catastrophic attack on the powers of the Agong.

There is either negligence going on here, or a serious attempt to curtail the power of the Agong.

The only way the erosion of powers of the Agong can be prevented is by the government to send a firm letter to the WHO rejecting the adoption of the new IHR by December 1 this year. Otherwise the powers of the Agong will be curtailed by international law.

Anwar must explain why the Madani government is allowing this attack on the sovereignty of the Malay rulers.

Khairy Jamaluddin was the responsible minister at the time. He was elected the World Health Assembly vice president, and Dr Noor Hisham was the DG responsible. Both must be called back to explain.
