Criminal charges of themselves do not constitute a crime or an offence. It is a charge which the prosecution may on consideration deem unsustainable on the basis of all the evidence before it or the fact that some critical aspects of the puzzle are missing (Jho Lo in the Najib case).

Just because a previous administration thought they had a great water tight open and shut case, does not mean the current administration has to agree with their assessment of the charges.

Conversely, the current administration may have considered the nature of the evidence and the charges against Zahid and decided that in the interests of comity within the party and to avoid a further embarrassment to the office of the DPP and the courts decided that dropping the charges against Zahid may be the best decision to take out of several bad choices available to it.

It is not illegal or unconstitutional for a government in the exercise of its powers and discretions to pardon someone like Anwar as they have done; or as they have done to convict DS Najib on the flimsiest of evidence because they have the right, power and authority to do so. It may be unconstitutional but hardly unlawful.
