The abuse of process and the misuse of the courts to frame people without any discernable evidence of admissible quality has dogged the Malaysian courts for some time. Thank the US
and British sponsored and financed Regime Change programs for the problem. Very much like what Tony Blair did a few years ago after killing millions of Irakis. He had the nerve then to come forward and admit to having led Britain into a war which Britain should not have gotten into in the first place. The evidence he admitted was fatally flawed. A bit too little a little too late. The object of destroying Irak and turning it into an unliveable mess except for roughnecks drilling for oil now belonging to the west.
Likewise someone along with a compliant incompetent criminal Malaysian Bar has been filing charges, criminal charges against politicans they do not like. Its like throwing mud. Some of it is bound to stick.
To suggest Tommy Thomas did anything worthy of a mention is like saying "well Hitler did somee good things too. His Nazis werre responsible for BMW (which was famous first for building gas chambers and cremetoriums for killing Jews), then of course his friend Dr. Porsche cretaed the Porsche and Volkswagen, and Hugo Boss whose suits even King Charles wears designed the Nazi and Gestappo uniforms. And the list goes on.
"... which Britain should not have gotten into in the first place. The evidence he admitted was fatally flawed" Well, Tony the war criminal got very rich and all...
We mustn't forget our barbaric Islamist monkeys also went to Iraq, Syria, Yemen to help the US, UK, Saudi, Gulf States by participating viciously in the massacres, torture, maiming, raping...
In order to convict Muyhideen, the prosecution haas to be able to deliver a brief of evidence which arises first out of investigations and other steps they must follow in orrder to justify proceeding with a case.
The criminal prosecution process can be long and complex, and involves a host of people, ranging from investigators, prosecutors and court staff to the defendant and their solicitors. As the DPP is a national office it is important to recognise that practices may vary given that State and Territory laws of procedure apply to the prosecution process. In Muyhideens case it amy be the DPP who innitiates the process.
1. Investigation
The DPP prosecutes federal offences and has no investigative powers. The role of the investigator is to take statements from witnesses and collect evidence to be used in criminal prosecution. Statements may be taken from the victim of the crime and from other people who may know something about the incident. Once the investigator considers enough evidence has been gathered to substantiate a criminal charge, this evidence is compiled in a brief. Briefs of evidence are referred to the DPP by investigators and include things such as witness statements and physical evidence, for example photographs and recordings. Once a brief of evidence has been referred to the DPP and a prosecution commenced the investigator becomes known as the informant.
2. Brief Assessment/Decision to Charge
These briefs that are referred to the DPP are then assessed by prosecutors in accordance with the Prosecution Policy of the Federal government. The decision whether or not to prosecute is the most important step in the prosecution process. A prosecution will be instituted when there are:
*reasonable prospects of securing a conviction; and
*the public interest requires a prosecution.
If charges have already been laid without the matter first being referred to the DPP, the DPP will consider whether that charge should be maintained and how the matter should proceed.
By the way the DPP is not the Deputy Public Prosecutor as most Malaysian lawyers and even judges refer to the position as. It stands for Director of Public Prosecutions and not Deputy Public Public Prosecutor. Theree is no such position as Deputy Public Prosecutor.
While Malaysians are pointing the finger at our crap system and it's various crap organisations and players, we should be reminded it is the people who elected and will still elect our corrupt politicians to spread the rot all-round, very likely forever.
There's actually not enough evidence to convict Najib either. Time will tell and there will be plenty of idiotic red faces all round.
Meanwhile, why is there no will to grab Fat Jho? Our guys already know he is in Dubai, Macau, Hong Kong, China... And he's disguised as an old man with rejigged face. Looks like our crooked lot don't want him back.
With our Keystone comics, Old Man Jho might be here all these while. And having a whale of a jolly time hovering around our corrupt politicians, judiciary, and law enforcers.
I say, offer a rm10 million bounty on Jho. You might be surprised it is Jho's buddies in politics who find him and turn him over
The political system has gone kaput. Those who think institutional reforms ( meaningful ones and not gimmicks) are possible do not understand the rot that has engulfed the country
Bersatu/PAS have to start articulating new fundamental reforms:
1- Put forward a plan that can assure non-Muslims their freedom and a way of life of their choice. If the Prophet can sign a treaty of Najran that gives Christians and Jews in Medina a peaceful and functioning govt, why can't we do this here?
Our model so far relied on the BN model, which is clearly outdated. Even the leading players in BN have come and gone. There is no replacement model yet
Don't behave like DAP and rely on the provisions of the Federal Constitution. Words are empty unless leade rs give meanings.
2- Democratise our country so the people are free. Start with repealing the Societies Act. Here the Agoing appoints the Registrar of Societies. That's how vital societies are in a democracy. Enact a new one where the Agong appoints the Registrar directly
Under the present Constitution, the Agong appoints the Registrar, but invariably and erroneously, Istana acted on PM's advice. A new Societies Act is needed, one that energies the people. Let civility and democracy live and put politics in its rightful place
.
The provisions in the current Societies Act are put there by autocratic leaders of political parties like Umno and left unchanged by pseudo-reformists like PKR and DAP. The current Societies Act makes political parties authoritarian in governing a democracy.
3- the Malay Rulers ( collectively the Istana) must have their own Attorney General equivalent. Our Constitution intended to make the AG the primary legal advisor to the Agong. By erroneous practice, he has become an Adviser to the PM.
How on earth does the King act on his residual powers( where he does not need to act on the advice of the PM) if Istana has to rely on AG, who also advises the PM? If the PM asks for a declaration of Emergency for example, after consulting the AG, then who does the Istana consult that can give independent advice?
How do the state govt and state Rulers act independently when relying on state legal advisers from the AG’s office? The Istana must seriously look at the flaws in the system
4- The Constitution prescribes that the Election Commission be independent. The Agong can directly appoint the members of the Commission. That's why the words “acting on advice “were omitted. A reformist led govt must restore the independence of the Election Commission in its true sense and not subject to PMO posturing
5- Bersatu / Pas must provide a transparent and fair form of revenue sharing between the states and the federal. This will ensure the development of infrastructure is fairly distributed. Power-crazy leaders will continue to discriminate against the parties they dislike. This will cause instability. It's also unIslamic
Quality of AG officers below par - rot is there and need a complete revamp - Tommy Thomas did a good job with Ram, and the rest. Do you see any political will to make the necessary changes? The perception towards judiciary after Tun's attack on it, has show tremendous results now

There's enough evidence.
Just ask our bent politicians.
And the kangaroos.

Tainted judges, corrupt court people and ruthless solicitors, these are the new power cabal. If Malaysia doesn’t fall, it will be a miracle.
Heard that there maybe a few charges on you as well even though your son was the one who signed the cheque and that expenses was perfectly legit.
Your neighbours and relatives are now wondering will the charge stick
